A judge delivered a gut punch to Fani Willis’ lawfare against Donald Trump.
Democrats are seething.
And Fani Willis got a bad ruling in court that changes everything.
As Conservative Reboot reports:
Judge Scott McAfee previously threw out three counts of the 13 counts in the bogus 2020 election indictment against Trump.
The charges McAfee tossed related to the so-called “fake electors” plan which was really the Trump campaign following the advice of lawyers to file an alternate slate of electors so as to maintain the viability of legal challenges.
“The charges in question — filing false documents, attempting to file false documents and criminally conspiring to file false documents — primarily relate to the meeting of 16 Trump electors on Dec. 14, 2020, to cast electoral votes for the incumbent president even though he lost the state. The electors signed certificates that were mailed to the National Archives, Congress and federal court, actions that Willis said amounted to forgery,” the Washington Post reported.
Judge McAfee threw out these charges for a simple reason.
Fani Willis is the prosecutor in Fulton County.
Fani Willis has no authority to enforce federal law.
“The Supremacy Clause declares that state law must yield to federal law when the two conflict,” McAfee wrote in his ruling.
Trump lawyer Steve Sadow applauded Judge McAfee following the law in this ruling and declared his intention to have the remaining sham charges against Donald Trump dismissed as well.
“President Trump and his legal team in Georgia have prevailed once again,” Sadow posted on X. “The trial court has decided that counts 15 and 27 in the indictment must be quashed/dismissed.”
Judge McAfee ruling that Willis lacked the constitutional power to prosecute Trump for federal crimes raised eyebrows as this rationale should have applied in Alvin Bragg’s rigged show trial.
In the falsification of business records case, Bragg bumped up a misdemeanor where the statute of limitations expired to 34 felony counts by fabricating a federal campaign finance violation charge that didn’t exist.
Alvin Bragg had no basis in law to prosecute this case against Donald Trump yet Democrat Judge – and Joe Biden campaign donor – Juan Merchan allowed this blatantly unconstitutional case to proceed.
The conviction Bragg won will get thrown out on appeal either at the state level or in the Supreme Court.
But it never should have gotten to this point in the first place.
All Judge Merchan had to do was follow the law and the Constitution just as Judge McAfee did and follow the Constitution’s framework that local prosecutors don’t prosecute federal cases.
