Will Democrats Use the 25th Amendment to Remove Joe Biden?

Democrats are facing tough choices involving Joe Biden.

It’s getting towards decision time.

And Kamala Harris can use this power play to remove Joe Biden from office.

As American Patriot Daily reports:

Special counsel Robert Hur turned in one of the most politically devastating reports in American history.

Hur’s report revealed that he couldn’t recommend criminal charges against Joe Biden for stealing classified documents because Biden is too senile to stand trial.

“Based on our direct interactions with and observations of him, he is someone from whom many jurors will want to identify reasonable doubt,” Hur stated. “It would be difficult to convince a jury that they should convict him—by then a former president well into his eighties—of a serious felony that requires a mental state of willfulness.”

If Joe Biden isn’t mentally competent to face criminal charges then many Americans believe he’s not mentally competent to carry out his duties as the commander-in-chief.

Former federal prosecutor Andrew McCarthy raised this argument on Fox News and said it presented the real possibility that Vice President Kamala Harris and the Cabinet would have to step in and remove Biden from power using the 25th Amendment declaring Biden mentally incapacitated.

“Well, my first impression was that this is supposed to be about whether there’s enough evidence to indict, and as you read the report, I can’t help but say it sure looks like there’s enough here, to invoke the 25th Amendment. And I know that’s not what he’s looking at, what his purpose is, but his fitness for office is a major issue here,” McCarthy told Fox News viewers.

According to the 25th Amendment, between Harris and a majority vote by the Cabinet it is enough to remove Biden and make Harris the president.

“Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President,” the 25th Amendment reads.

But putting Harris in charge presents its own issues.

According to a recent NBC News poll Harris was the most unpopular political figure pollsters tested with just a 28-percent approval.

And if Democrats thought Harris could actually win a general election Joe Biden wouldn’t be so determined to run.
