Alvin Bragg Wins Key Court Victory Over Donald Trump

Alvin Bragg was the first Democrat prosecutor to bring criminal charges against Donald Trump.

Bragg’s witch hunt will go to trial in the middle of the GOP presidential primary.

And now Donald Trump is going to hate what Alvin Bragg just did.

As American Patriot Daily reports:

Bill Clinton Judge Alvin Hellerstein rejected Donald Trump’s motion to move the criminal case filed against him by District Attorney Bragg to federal court.

Hellerstein brushed aside the obvious argument Trump made that since Bragg claimed Trump violated federal law the case should be tried in federal court.

“Falsifying business records to hide such reimbursement, and to transform the reimbursement into a business expense for Trump and income to Cohen, likewise does not relate to a presidential duty,” Hellerstein wrote. “Trump is not immune from the People’s prosecution in New York Supreme Court. His argument of immunity is not a colorable defense.”

“The mere fact that Trump is alleged to have engaged in fraudulent conduct with respect to a federal election is not a basis for preemption,” Hellerstein added. “There is no colorable basis to support a federal preemption defense.”

Bragg invented a nonsense legal theory that even liberal analysts rejected to charge Trump with 34 felonies for falsifying business records.

The indictment charged Trump with falsifying business records to hide non-disclosure agreement payments from Michael Cohen to Stormy Daniels in 2016.

To boost this charge up to a felony Bragg needed to show Trump falsified the records in furtherance of another crime.

Bragg claimed Trump falsified the business records to hide a federal campaign finance violation.

To show just how bogus this claim was, even the weaponized Biden Justice Department declined to prosecute Trump on this charge.

Anti-Trump special counsel Jack Smith failed to win a conviction on similar charges against former presidential candidate John Edwards so even highly partisan Attorney General Merrick Garland took a pass.

Bragg knows he is bringing a baseless and novel – meaning untested – legal theory into court and moving the case to the federal jurisdiction would take the homefield advantage away from Bragg.

Instead, Bragg – a partisan Democrat – will try this case in front of a Democrat judge that donated to Joe Biden in the 2020 campaign and pick a jury from the pool of Democrat voters that elected him to office in part based on Bragg’s campaign promise to indict and jail Donald Trump.

It is a clear set-up to stack the deck and rig the trial against Trump.

Even though the case is likely to get tossed out on appeal, the point of the matter is to tie Trump up with criminal trials – since these proceedings are criminal in nature Trump must attend in person – which is why Bragg and his fellow Democrat prosecutors plan to indict Trump four different times to try and keep him off the campaign trail for all of 2024 by tying up his days with court appearances.
